Kuwait nears completion of new media regulation law

Law would not include imprisonment penalties except in two cases: Al-Mutairi

KUWAIT: The Ministry of Information is nearing the completion of a new media regulation law aimed at balancing freedom of expression with responsible media practices, according to Minister Abdulrahman Al-Mutairi. The law, which is set to be announced soon, will seek to enhance responsible freedom and provide the necessary space for media activities, while maintaining safeguards against violations.


Speaking on the sidelines of a presentation to the media on Kuwait’s designation as Arab Capital of Culture and Media 2025, Al-Mutairi explained that the new law would introduce specific penalties for violations while preserving the right to defend oneself legally. "This law will significantly contribute to promoting responsible freedom in the media and will grant the required space for media outlets to operate effectively," said Al-Mutairi.


The law aims to regulate media practices without stifling freedom of expression. It includes steps to impose legal penalties for violations, ensuring that such measures are proportionate and just. The Minister added that the law would not include imprisonment penalties except in two exceptional cases: defamation of the divine entity and prophets, or defamation of the ruling authority. "Penalties will be applied based on legal interpretations, but imprisonment will not be used except for these two cases," he clarified.


Al-Mutairi also expressed confidence in the professionalism and balance of Kuwaiti media outlets, noting that over 95 percent of them are committed to legal and ethical standards. However, he acknowledged concerns surrounding personal accounts and fake profiles, which have a detrimental effect on media practices and the freedoms enjoyed by citizens. "Certain trends have negative effects on our society, and these issues need to be addressed," he added.


Kuwaiti media has long been recognized for its responsible approach to freedom of expression. Al-Mutairi emphasized that media outlets in Kuwait have demonstrated their commitment to societal unity, identity, and the protection of individual rights through their coverage of various events.


"The upcoming law aims to establish a framework that ensures responsible freedom while protecting both state institutions and individual liberties," said Al-Mutairi.


A discussion session held previously to review the law received positive feedback from the media, with no major objections raised, said Al-Mutairi. The Ministry of Information hopes the new law will help ensure that Kuwait's media environment remains vibrant, balanced, and aligned with the country's legal framework. The final version of the law will be unveiled in the near future and is expected to be a key tool in shaping the future of media regulation in Kuwait.
